This Agreement is entered into by and between Haul Star Rental, LLC ("Company"), located in North Ogden, Utah, and the undersigned individual ("Renter") regarding the rental of Company-owned dump trailers. By signing this Agreement, Renter acknowledges they have read, understood, and agree to all terms and conditions set forth herein. This is a legally binding contract.

1. ASSUMPTION OF RISK

Renter voluntarily and expressly acknowledges that using, towing, loading, and operating a dump trailer involves inherent risks, including but not limited to: bodily injury or death, vehicle accidents or rollovers, cargo shifting or spillage, trailer detachment or hitch failure, equipment malfunction, and property damage. Renter knowingly and voluntarily assumes all such risks and accepts full personal responsibility for the safe operation, towing, loading, and return of the trailer throughout the entire rental period.

2. RELEASE OF LIABILITY

To the fullest extent permitted by the laws of the State of Utah, Renter knowingly, voluntarily, and expressly releases, waives, and forever discharges Haul Star Rental, LLC, its owners, members, managers, employees, agents, and successors ("Released Parties") from any and all claims, demands, actions, damages, losses, costs, or liabilities of any kind arising from Renter's use of the rental trailer, including personal injury or death, property damage, vehicle damage, third-party claims, and financial losses. RENTER EXPRESSLY UNDERSTANDS AND AGREES that this release applies to claims arising from the ordinary negligence of the Released Parties, except where prohibited by law. This release does NOT apply to claims arising from gross negligence or willful misconduct. Renter has had the opportunity to seek independent legal counsel prior to signing.

3. INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all third-party claims, suits, demands, losses, damages, fines, penalties, costs, and attorneys' fees arising out of or relating to: Renter's use or misuse of the trailer, damage caused to any person or property, violation of any law or regulation, loss or theft of the trailer, or any breach of this Agreement.

4. CONDITIONS OF USE

Renter certifies that they: (a) are 21 years of age or older with a valid U.S. driver's license; (b) have presented valid photo ID at pickup; (c) have a tow vehicle with a manufacturer-rated towing capacity meeting or exceeding the trailer's GVW; (d) will use a properly rated hitch ball, working lights, safety chains, and brake controller (required for 7×14); (e) have inspected the trailer and accept it in its current condition; (f) will not haul hazardous, toxic, flammable, or illegal materials; (g) will not allow any unauthorized person to operate the trailer; (h) will return the trailer clean (a $50 cleaning fee applies if returned dirty).

A $25/hour late fee applies for trailers returned after the agreed time without prior approval. Renter is responsible for all damage, loss, or theft during the rental period, regardless of cause.

5. PRE-RENTAL INSPECTION & PHOTO DOCUMENTATION

Company and Renter agree to jointly photograph the trailer at pickup (all four sides, hitch, tires, and bed). These photos serve as the definitive record of pre-rental condition. Any damage discovered upon return not documented at pickup is presumed to have occurred during the rental and is Renter's sole financial responsibility.

6. PAYMENT TERMS

Full payment is required at the time of booking to confirm the reservation. No additional payment is due at pickup. Cancellations made 48 or more hours before pickup receive a full refund. Cancellations less than 48 hours before pickup are non-refundable. No-shows without notice are non-refundable.

7. INSURANCE & FINANCIAL RESPONSIBILITY

Renter is strongly encouraged to verify that their auto insurance covers trailer towing. Haul Star Rental maintains commercial insurance for business liability; this coverage does not protect Renter from personal liability. Renter will be billed actual repair or replacement costs for any damage not covered by Company's insurance. In the event of an accident or damage, Renter must immediately contact Company at (801) 580-0209.

8. NO WARRANTIES

The trailer is provided "AS IS" with no warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or safe condition.

9. GOVERNING LAW

This Agreement is governed by the laws of the State of Utah. Any legal action must be brought in Weber County, Utah. The prevailing party shall be entitled to recover reasonable attorneys' fees. If any provision is found unenforceable, the remaining provisions remain valid.

10. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties. Renter acknowledges they have read this Agreement in its entirety, had the opportunity to ask questions and seek legal counsel, and are signing freely and voluntarily without duress.
